You agree to indemnify, defend, and hold harmless TheAfterEve, Inc. and its directors, employees, affiliates, licensors, and service providers from any claims, liabilities, damages, losses, and expenses, including attorneys’ fees, arising out of or related to your use of the Website, your breach of this Agreement, or any violation of any law, regulation, or the rights of a third party.

By using theaftereve.com, you are using this material by your own consent and do not hold I Still Rise LLC DBA TheAfterEve liable for decisions based on the products, services, or information provided.  

8. Disclaimer of Warranties

The Site and all content, materials, and services provided therein are provided ‘as is’ and ‘as available’ without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. TheAfterEve Inc. / theaftereve.com makes no representations or warranties about the accuracy, completeness, reliability, or availability of the Site.

9. Data Collection and Privacy

By using the Site, you consent to our collection and use of your personal information as described in our Privacy Policy. We may collect certain data, including but not limited to, usage statistics and device information, to improve the functionality and user experience of the Site. 11. Termination of Access

We reserve the right to terminate or suspend your access to the Site at our discretion, without notice, for any reason, including if we believe you have violated the terms of this Agreement. Upon termination, you must immediately cease using the Site. All provisions of this Agreement that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Washington, without regard to its conflict of law principles. Any disputes arising out of or relating to this Agreement or the use of the Site shall be resolved exclusively in the courts of the State of Washington, and you consent to the jurisdiction of such courts.

13. Arbitration and Dispute Resolution

Any disputes, claims, or controversies arising out of or in connection with this Agreement or the use of the Site shall be resolved exclusively through binding arbitration administered by a neutral arbitration provider of our choosing, under its rules and procedures, except as otherwise provided herein. The arbitration shall be conducted in King County, State of Washington, and the language of the arbitration shall be English.

• Arbitration Fees and Costs: You agree to pay your own costs and fees associated with the arbitration, except that TheAfterEve, Inc. and theaftereve.com will bear the cost of the arbitrator’s fees and any administrative fees up to a maximum of $1 USD. You will bear your own legal fees, unless you are entitled to recover them under applicable law. The arbitrator shall have the discretion to allocate costs and fees as they deem appropriate, including if you lose the arbitration.
  
• No Class Actions: The arbitration shall be conducted on an individual basis, and you agree that you will not participate in a class action, class arbitration, or representative action. No arbitration shall be combined with any other arbitration or joined with any other dispute.
  
• Binding Arbitration: The decision of the arbitrator shall be final and binding on the parties. You waive any right to appeal or seek judicial review of the arbitrator’s decision to the fullest extent permitted by law.
  
• Injunctive Relief: Notwithstanding the foregoing, theaftereve.com shall have the right to seek temporary, preliminary, or permanent injunctive relief or other equitable remedies in any court of competent jurisdiction to protect its intellectual property rights or to prevent unauthorized access, use, or distribution of its content.
  
• Location of Arbitration: Unless you and theaftereve.com mutually agree otherwise, the arbitration will take place in King County, State of Washington, and all arbitration proceedings shall be conducted in the English language. You agree to submit to the personal jurisdiction of the courts located in King County, State of Washington, for purposes of enforcement of any arbitral award.
  
• Arbitrator’s Authority: The arbitrator will have no authority to award punitive or exemplary damages and may not award relief that is inconsistent with the provisions of this Agreement. The arbitrator shall be required to apply the laws of the State of Washington.
  
• Prohibition of Jury Trials: By agreeing to arbitration, you expressly waive any rights you may have to a trial by jury for any dispute or claim arising from or related to this Agreement.
  

14. Force Majeure

TheAfterEve, Inc. / theaftereve.com shall not be liable for any failure or delay in performance of its obligations under this Agreement due to causes beyond its reasonable control, including but not limited to acts of God, fire, flood, war, terrorism, strikes, power outages, or government actions.

15. Intellectual Property

All content, trademarks, logos, and materials on the Site are owned or licensed by TheAfterEve, Inc. /  theaftereve.com and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.

16. Non-Transferability

You may not assign or transfer your rights or obligations under this Agreement to any third party without the prior written consent of theaftereve.com. Any unauthorized assignment shall be null and void.

17. Entire Agreement

This Agreement constitutes the entire agreement between you and theaftereve.com with respect to your use of the Site and supersedes all prior or contemporaneous communications, whether oral or written, between you and TheAfterEve, Inc. / theaftereve.com.

18. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.
